Proposal to Suspend Abusive Sanctions in Stadiums

Supporters are the heart of sports

Sebastian Burduja and a group of liberal parliamentarians have initiated a proposal to amend Law 4/2008 so that the fines issued at stadiums would be suspended from enforcement once a complaint is filed against the official report that imposed the sanction. In practice, this would apply the same general regime of contraventions that already applies to drivers and all other citizens.

“Acts of violence must be severely punished, and there is already a legal framework and technical means to do so. Those guilty of violent acts must be identified and sanctioned accordingly. What we cannot do is punish all supporters collectively for the mistakes of a few.
In the current situation, a supporter who is unfairly penalized remains banned from attending sporting events until a final court decision, even if they are innocent. Moreover, through this new legislative proposal, the decision to maintain or lift the ban during the trial will rest with the judge, who may allow attendance until the case is resolved.

The current form of the law has led to situations where people were fined collectively, without identifying the actual author of the act, and the Romanian state has lost many court cases due to the disproportionality of the measure.

Recently, football supporters have raised alarms about the ambiguity of Law 4, as many of its provisions have been interpreted in an extreme way, restricting free expression and leading to abuses. We thank the senators from PNL, USR, and AUR who welcomed us and offered their support.
